Privacy Policy

Interimage Watch Calculator (the "App") is provided by Shonan Logic Provide (the "Developer"). We respect your privacy and handle your data with the utmost care.

Article 1 (Information Collected)

  1. Image Data: Photos of analog watches taken/transmitted by users for AI training and model improvement.
  2. High-Precision Time: Accurate time metadata (based on atomic clocks) captured at the time of photography to ensure dataset quality.
  3. Support Identifier (User ID): A randomly generated ID per installation to manage data and handle deletion requests without identifying specific individuals. No names, addresses, or phone numbers are directly collected.
  4. Device Info & Ad ID: Device model, OS version, and Google Advertising ID (AAID) for analytics and ad delivery.

Article 2 (Purpose of Use)

  1. To provide, maintain, and manage the App.
  2. For AI model training, accuracy improvement, and research/development.
  3. To create image datasets and to provide or sell such datasets to third parties (AI developers, research institutes, etc.).
  4. For ad delivery (Google AdMob) and analytics (Firebase Analytics).
  5. To respond to data deletion requests and inquiries.

Article 3 (Data Processing & Privacy)

  1. Removal of Location: GPS metadata (latitude/longitude) is removed upon server storage.
  2. Data Retention: "Capture Time" and "Technical Camera Info" are retained/processed as essential data for the dataset.
  3. Exclusion of PII: If faces or identifiable info are inadvertently included, the Developer will endeavor to delete or mask (blur) such information at its discretion.

Article 4 (Third-Party Provision)

  1. Commercial Use & Sale: Processed image and time data may be provided or transferred (for a fee or free) to third parties for AI development or research.
  2. Legal Compliance: When required by law.

Article 5 (Collection Modules & Infrastructure)

Article 6 (Deletion & Opt-out)

Opt-out (Stop Transmission): Users can stop the automatic transmission of image data at any time by turning off the "Data Contribution" toggle in the App's settings.

Deletion Request: Users may request deletion of their submitted images by providing their "Support ID." Note that data already sold/provided to third parties or incorporated into AI training results may be impossible to delete.

Article 7 (Disclaimer)

The Developer is not liable for any damages arising from the use of the App, except in cases of intentional misconduct or gross negligence.

Terms of Service

Article 1 (Consent)

By using the App, users agree to these Terms and the Privacy Policy.

Article 2 (Submission Guidelines)

  1. Subject: Capture only the "watch face."
  2. Privacy: Ensure no identifiable info (faces, addresses, reflections) is included.
  3. Rights: Upload only images you own the rights to or have legal permission for.

Article 3 (Prohibitions)

  1. Submitting images containing personal or sensitive info.
  2. Submitting content that is offensive or infringes third-party rights.
  3. Submitting false data or interfering with AI learning.
  4. Analysis, modification, or reverse engineering of the App.

Article 4 (Rights & Licensing)

  1. Copyright: Remains with the user.
  2. License: Users grant the Developer a worldwide, non-exclusive, perpetual, royalty-free, and sublicensable license to use images for AI training, dataset creation, and third-party provision/sale (commercial use).
  3. Moral Rights: Users agree not to exercise moral rights against the Developer or its successors/licensees.

Article 5 (Disclaimers)

  1. "AS IS" Basis:The App is provided on an "AS IS" and "AS AVAILABLE" basis. The Developer makes no warranties, express or implied, regarding the accuracy, reliability, or fitness for a particular purpose of the AI analysis results or the App’s functions.
  2. Limitation of Liability:To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or device functionality arising from the use of the App.
  3. Third-Party Content & Services:The App may utilize third-party services (e.g., Google AdMob, Firebase, Cloudflare). The Developer is not responsible for the content, privacy policies, or practices of any third-party services.
  4. Data Irreversibility:The User acknowledges that once data is provided to third parties or integrated into AI models as per the Privacy Policy, the Developer may be unable to delete such data even upon request.
  5. Compliance with Local Laws:Users are responsible for ensuring that their use of the App complies with all applicable local laws and regulations.

Article 6 (Changes)

The Developer may change these Terms at any time without notice. Changes are effective upon posting.

Article 7 (Governing Law)

Governed by the laws of Japan. Exclusive jurisdiction: District Court of the Developer's residence.

プライバシーポリシー

Interimage Watch Calculator（以下、「本アプリ」）は、Shonan Logic Provide（以下、「当方」）が提供するアプリです。当方は、ユーザーのプライバシーを尊重し、データの管理に細心の注意を払います。

第1条（取得する情報）

  1. 画像データおよび付随データ：AI学習およびモデル改善のために撮影・送信されたアナログ時計等の画像データ。
  2. 高精度な時刻情報：データセットの品質向上のため、画像撮影時に取得した正確な時刻情報（原子時計等に基づくもの）を取得・保存します。
  3. サポート用識別子（User ID）：個人を識別することなく、データの管理および削除請求に対応するため、ランダムに生成された識別子を取得します。氏名等の個人情報は取得しません。
  4. 端末情報および広告ID：利用状況の解析および広告配信のため、OSバージョン、Google Advertising ID（AAID）等を取得します。

第2条（利用目的）

  1. 本アプリの機能提供および維持・管理。
  2. AIモデルの学習、精度向上、および研究開発。
  3. 収集した画像データセットの作成、および当該データセットの第三者（AI開発企業、研究機関等）への提供・販売。
  4. 広告の配信（Google AdMob）および解析（Firebase Analytics）。
  5. ユーザーからの削除請求やお問い合わせへの対応。

第3条（データの加工とプライバシー保護）

  1. 位置情報の削除：画像に含まれるGPS位置情報（緯度・経度）は、サーバー保存時に削除します。
  2. 情報の保持：データセットに必要な「撮影日時」および「カメラの技術的情報」は、第1条に基づき保持されます。
  3. 個人情報の排除：意図せず人物の顔等が含まれていた場合、当方の判断に基づき削除またはマスキング加工に努めます。

第4条（情報の第三者提供）

  1. データセットの商用利用・販売：加工された画像データおよび時刻情報は、AI開発等を目的とする第三者に対し、有償または無償で提供・譲渡される場合があります。
  2. 法令に基づく場合：法令に基づき開示が必要な場合。

第5条（情報収集モジュールおよびインフラストラクチャ）

第6条（データの削除およびオプトアウト）

オプトアウト（送信停止）： ユーザーは、本アプリの設定画面にある「Data Contribution」スイッチをオフにすることで、いつでも画像データの自動送信を停止することができます。

削除請求： 送信済みのデータの削除を希望される場合は、「サポート用ID」を添えてご連絡ください。ただし、既に第三者へ提供・販売済みのデータやAIモデルに取り込まれたデータについては、削除不可能な場合があります。

第7条（免責事項）

当方は、本アプリ利用により生じた損害について、故意または重過失がある場合を除き、一切の責任を負いません。

利用規約

第1条（同意）

ユーザーは、本アプリを利用することで、本規約およびプライバシーポリシーに同意したものとみなされます。

第2条（画像送信時の順守事項）

  1. 被写体：原則として「時計の盤面」のみを撮影してください。
  2. 個人情報の排除：顔、住所、鏡面への映り込み等、個人を特定できる情報が含まれないよう確認してください。
  3. 権利の確認：自身が著作権を有する、または適法に送信できる画像のみをアップロードしてください。

第3条（禁止事項）

  1. 個人情報や機微情報を含む画像の送信。
  2. 公序良俗に反する、または第三者の権利を侵害する画像の送信。
  3. 虚偽データの送信や、AI学習を妨害する行為。
  4. 本アプリの解析、改変、リバースエンジニアリング。

第4条（送信データの権利帰属および利用許諾）

  1. 著作権：ユーザーに留保されます。
  2. 利用許諾：ユーザーは当方に対し、画像をAI学習、モデル改善、データセット作成、および**第三者への提供・販売（商用利用）**のために利用する、世界的、非独占的、永続的、無償、かつサブライセンス可能な権利を許諾します。
  3. 権利の不行使：ユーザーは、当方および当方から権利を継承した第三者に対し、著作者人格権を行使しないことに同意します。

第5条（免責事項）

  1. 現状有姿での提供：本アプリは「現状有姿」かつ「提供可能な範囲」で提供されます。当方は、AI解析結果の正確性、信頼性、または特定の目的への適合性について、明示的か黙示的かを問わず、一切の保証をしません。
  2. 責任の制限：適用法が許容する最大範囲において、当方は、本アプリの使用に起因する利益の損失、データの消失、端末機能の不全を含む、いかなる間接的、付随的、特別、派生的、または懲罰的損害についても責任を負いません。
  3. 第三者サービス：本アプリは第三者のサービス（Google AdMob、Firebase、Cloudflare等）を利用する場合があります。当方は、これら第三者サービスの内容、プライバシーポリシー、または慣行について責任を負いません。
  4. データの不可逆性：プライバシーポリシーに基づき、既に第三者へ提供済み、またはAIモデルに統合されたデータについては、ユーザーからの請求があっても削除できない場合があることを承諾するものとします。
  5. 現地法の遵守：ユーザーは、本アプリの使用が居住国の適用法および規制に準拠していることを自ら確認する責任を負うものとします。

第6条（規約の変更）

当方は、いつでも本規約を変更できるものとします。変更後の規約は掲示された時点で効力を生じます。

第7条（準拠法・裁判管轄）

日本法を準拠法とし、当方の居住地を管轄する地方裁判所を専属的合意管轄裁判所とします。
